1. Purpose of This Consent
This Marketing Consent explains how UWELL obtains, records, manages, and relies on consent to send commercial electronic messages in connection with UWELL CREW.
This consent is intended to support compliance with Canada’s Anti-Spam Legislation (“CASL”) and applies to promotional email, SMS, and similar electronic messages sent by or on behalf of UWELL.
2. What You Are Consenting To
If you give consent, UWELL may send you commercial electronic messages relating to:
- UWELL CREW membership offers;
- points, tier, and rewards promotions;
- product education and feature announcements;
- special campaigns, contests, sweepstakes, and launches;
- surveys, engagement campaigns, and community participation opportunities;
- brand news, promotional content, and marketing updates;
- reminders about incomplete registration, reward eligibility, or account-related promotional opportunities.

6. Transactional vs. Marketing Messages
This Marketing Consent applies only to commercial electronic messages that require consent under CASL.
UWELL may still send non-marketing or transactional messages related to your account, product registration, security, legal notices, reward fulfillment, or customer service where permitted by law and where no marketing consent is required.
7. Consent Collection Rules
UWELL will request express consent using an opt-in mechanism that requires a positive action by the user. Pre-checked boxes, default-on toggles, silence, or inactivity will not be treated as express consent.
A request for consent will clearly state:
- the purpose for which consent is being sought;
- the name of the person seeking consent;
- the name of the person on whose behalf consent is sought, if different;

- the version of the consent language shown at the time of consent;
- the contact details provided;
- IP address, device, or session data associated with the consent event where appropriate;
- unsubscribe requests and the actions taken in response.
9. Implied Consent
Where permitted by CASL, UWELL may rely on implied consent in limited circumstances recognized by law.
If UWELL relies on implied consent, UWELL may restrict the scope or duration of communications and may stop sending marketing messages when the legal basis expires or can no longer be verified.
UWELL may decide, as an internal policy, to require express consent for certain channels, campaigns, or user segments even where implied consent may be available.
10. SMS / Text Message Consent
If you provide a mobile number and expressly opt in, UWELL may send marketing text messages where permitted by law.
Message frequency may vary. Message and data rates may apply depending on your carrier or mobile plan.
Text messages will include or link to legally required identification, contact, and unsubscribe information where direct inclusion is not practicable.
You may opt out of SMS by replying STOP where supported or by using another unsubscribe method provided by UWELL.
11. Email Consent
If you provide your email address and expressly opt in, UWELL may send promotional emails about UWELL CREW and related commercial activities.
Each marketing email will include sender identification, contact information, and an unsubscribe mechanism as required by law.
12. Referral-Related Messaging
Members must not use UWELL CREW referral features in a way that causes unlawful commercial electronic messages to be sent.
Where UWELL operates a referral tool, UWELL may limit how messages are sent, what content may be included, whether the message is sent by the member or by UWELL, and whether the recipient must first provide a lawful basis for contact.
UWELL may suspend or disable referral features where CASL risk, abuse, or complaint volume requires it.
13. Withdrawing Consent
You may withdraw consent at any time. Withdrawal does not affect the lawfulness of messages sent before the withdrawal was processed.
Once marketing consent is withdrawn, UWELL may continue to maintain records of the prior consent and the withdrawal for compliance, suppression, audit, and dispute-resolution purposes.
14. No Condition of Purchase
Marketing consent is not a condition of purchase, account registration, or participation in the non-marketing administrative parts of UWELL CREW, unless a specific optional feature inherently depends on promotional messaging.
15. Updates
UWELL may update this Marketing Consent from time to time to reflect changes in law, operations, messaging channels, or compliance requirements.
The updated version will be posted with a revised effective date.
